TERMS & CONDITIONS

These Terms & Conditions apply to coaching, training, rehabilitation, assessment, programming and related services provided by Alpine MTB Performance + Rehab.

Purchasing Services

Upon purchasing a training plan, coaching service, rehabilitation service, assessment, consultation, subscription or other service, the Client will receive confirmation through the applicable website, payment platform or client management system.

Questions regarding a purchase or service may be directed to Alpine MTB Performance + Rehab using the contact information provided through its website, invoice or client platform.

Refund Policy

Unless otherwise stated in writing for a specific service, program or event, all sales are final and fees paid are non-refundable.

Privacy and Security

Alpine MTB Performance + Rehab collects and uses personal information that is reasonably necessary to provide and administer its services. This may include contact information, health and injury information, assessments, training history, performance data, exercise information and Client communications.

Alpine MTB Performance + Rehab does not sell Client personal information.

Third-party services may be used to provide or administer services, including payment processing, coaching and training platforms, electronic communications, cloud-based software, data analysis and artificial intelligence-assisted tools. Personal information may be processed by these service providers where reasonably necessary for those purposes.

Alpine MTB Performance + Rehab will take reasonable measures to protect personal information against unauthorized access, use, disclosure, loss or misuse.

Some third-party providers may process or store information outside Canada. Information about applicable service providers, the countries in which information may be processed and the purposes for which they are used may be obtained by contacting Alpine MTB Performance + Rehab's designated Privacy Contact.

Use of Artificial Intelligence

Alpine MTB Performance + Rehab may use artificial intelligence and other automated tools to support the delivery of its services.

AI-assisted tools may be used to analyze training, performance, assessment or rehabilitation information, identify patterns or trends, summarize information and communications, assist with program development, refine coaching or rehabilitation recommendations and support administrative tasks.

Client information relevant to these purposes may be processed using AI-assisted software. Alpine MTB Performance + Rehab will take reasonable steps to limit information to what is appropriate for the intended purpose and to use AI tools in accordance with applicable privacy requirements.

Clients understand that AI-generated information can be inaccurate, incomplete, biased or incorrectly interpreted. AI is used as an assistive tool and does not replace professional judgment. Significant coaching, training or rehabilitation decisions will not be made solely by an automated AI system, and Alpine MTB Performance + Rehab remains responsible for the services and recommendations it provides.

By accepting these Terms & Conditions, the Client acknowledges that AI-assisted tools may be used as described above.

Client Responsibilities

The Client is responsible for monitoring their physical condition and well-being during training, rehabilitation and cycling activities.

Because some or all activities may be performed without an Alpine MTB Performance + Rehab coach or practitioner physically present, the Client agrees to monitor fatigue, pain, physical symptoms and other warning signs and to modify or discontinue activity when appropriate.

The Client agrees to communicate significant injuries, health changes, unusual symptoms or other concerns that may affect participation in the Program.

The Client is encouraged to follow appropriate nutrition, hydration and recovery practices and to maintain records or training logs when requested as part of the service.

Alpine MTB Performance + Rehab may modify, suspend or discontinue training or rehabilitation services if it reasonably believes that continuing the Program may be inappropriate or unsafe without further assessment or medical clearance.

Fees

Fees are subject to applicable taxes where required.

Fees must be paid according to the payment schedule associated with the applicable service. Failure to make required payments may result in suspension or termination of services.

Unless otherwise stated in writing, fees already paid are subject to the Refund Policy above.

Training Plans, Programs and Proprietary Materials

Training plans, rehabilitation programs, educational resources, written materials, videos, exercise libraries, programming systems, methodologies and other materials created or supplied by Alpine MTB Performance + Rehab remain the intellectual property of Alpine MTB Performance + Rehab or their respective rights holder.

The Client is granted a limited, personal and non-transferable right to use these materials for their own training, rehabilitation or education.

The Client may not reproduce, sell, publish, distribute, commercially exploit or provide Alpine MTB Performance + Rehab's proprietary materials to another person or organization without prior written permission.

Nothing in these Terms prevents a Client from sharing information reasonably necessary for their healthcare with a physician or other healthcare professional.

Confidentiality

Alpine MTB Performance + Rehab will maintain Client personal and confidential information in accordance with applicable privacy requirements.

Information may be accessed or processed by employees, contractors or third-party service providers where reasonably necessary to provide or administer services, maintain business systems, process payments, communicate with Clients or perform other legitimate service-related functions.

Clients may also receive confidential or proprietary materials belonging to Alpine MTB Performance + Rehab. Clients agree not to disclose or use those materials for purposes other than their own participation in the services except with prior permission or as otherwise permitted by law.

No Guarantee of Results

Training, rehabilitation, coaching and athletic performance are influenced by numerous individual and external factors.

Alpine MTB Performance + Rehab does not guarantee specific health, rehabilitation, fitness, competition, performance or other outcomes.

Acceptance of Terms

By purchasing, enrolling in or continuing to use services provided by Alpine MTB Performance + Rehab and accepting these Terms & Conditions through the applicable registration or client system, the Client confirms that they have read and understood these Terms & Conditions and agree to be bound by them.
